TERMS & CONDITIONS FOR BRITANNIA ANANDA VIRTUAL PARTY

1. Contest Details, Concept and Participation:

(i) These terms and conditions apply to the "Britannia Cake Mishti Moments Contest” for customers (hereinafter referred to as "Contest") sponsored and launched by BRITANNIA INDUSTRIES LIMITED (“Britannia”) wherein customers need to share their stories of small joys (these are everyday gestures of kindness, joy, talent and happiness which our loved ones do to make our lives happy. Like a kid helping a grandparent, husband helping his wife in cooking, son helping mom in using smart phones etc) with Britannia and Britannia will reward the selected winners by giving them Britannia Cake hampers and organising a Virtual party for their family and 4 of their friends; this party would also have an emcee and a famous celebrity will attend this party for some time to congratulate the winner.

(ii) Customers participating or seeking to participate in the Contest shall individually be referred to as "Participant" and collectively as "Participants".

(iii) The Contest is valid only in the city of Kolkata. Subject to the other eligibility criteria contained herein, the Contest is open to participation by all Indian citizens.

(iv) The contest will be valid from 12-06-2020 to 19-07-2020. (The entries can be sent from 12-06-2020 12:01 AM to 9-07-2020 11:59 PM).

(v) During the period of the Contest period, a total of 20 (5 winners per week for 4 weeks) winners will be selected on the basis of the entries they send. Every week the Top 5 stories will be selected by the Selection committee and the winners will be declared. Selection of the winners will be completely dependent on the discretion of the committee.

(vi) The Contest is subject to all applicable central, state and local laws and regulations.

(vII) Britannia does not guarantee that a particular celebrity would be a part of the virtual party. Decision on which celebrity would attend the party would be with Britannia.

(vIII) No request of re-scheduling the parties would be entertained by Britannia. Britannia is not responsible for any issues with internet connectivity during the parties.

2. Agreement to Terms and Conditions:

(i) By participating in the Contest, the Participants fully and unconditionally agree to and accept the Terms and Conditions which are available on https://bengali.abplive.com/britannia-cake-mishti-moments.html ("Contest Website"). The decisions of Britannia will be final and binding in all matters related to the Contest. Successfully entering the Contest and winning a prize is subject to all requirements set forth herein.

(ii) Britannia reserves the right to exclude any person from participating or winning the Contest on grounds of misconduct or criminal record or for any other reasons, as it may deem fit and proper. No communication in this regards will be entertained.

(iii) Britannia reserves the right to terminate, modify or extend the Contest and/or deletion or addition of any of the terms and conditions of the Contest at any time at its absolute discretion, without advance notice and / or assigning any reason thereof. Britannia may amend the type of Contest, submission mechanism, eligibility criteria, term of the Contest, and the prizes for the Contest; Britannia reserves the right to amend, temporarily suspend or withdraw the Contest in its absolute discretion provided that Britannia Brand shall not exercise this right unreasonably. All decisions of Britannia in respect of the Contest and the prizes therein will be final, binding and conclusive.

(iv) All intellectual property rights including trademark, copyright and designs used are the property of their respective owners.

3. Eligibility:

(i) This Contest will be open to all residents of Kolkata.

(ii) Subject to other criteria and conditions stated in the terms of the Contest, the Contest will be open to all residents of Kolkata with the exception of employees of Britannia, agents, distributors, retailers and any other channel partner of Britannia, and their immediate family members, and the agency (“Agency”).

(iii) This Contest is open for all Indian Citizens.

(iv) Britannia or its Agency will not be liable under any NDNC (National Do Not Call) Registry / DND regulation or such other regulation that exists or may come into play. Participants agree to receive communications related to the Contest even if they are registered under NDNC, DND (Do Not Disturb), or under any other similar regulation, Britannia or its Agency will have all the authority to call the Participant by virtue of them having voluntarily participated in the Contest.

4. Contest Period & Contest Timings:

(i) The contest will commence from 12.00:01 AM on 12-06-2020 and shall end at 11:59:59PM on 19-07-2020.

(ii) Time of participation will be defined as the time at which the entry is received through https://bengali.abplive.com/britannia-cake-mishti-moments.html or 7044025999 at the system of Britannia.

(iii) Entries coming outside the Contest period will not be considered for winner selection.

5. How to Participate: To participate in the contest, the participant shall send in their stories through the contest website-https://bengali.abplive.com/britannia-cake-mishti-moments.html or whatsapp number-7044025999 provided therein. The stories should not be more than 100 words and these need to be stories of small joys (these are everyday gestures of kindness, joy, talent and happiness which our loved ones do to make our lives happy. Like a kid helping a grandparent, husband helping his wife in cooking, son helping mom in using smart phones etc)

6. Winner Selection and Verification: Top 5 stories every week will be selected as winners by a selection committee on the basis of merit of each story and connect to the Mishti Moments campaign. The winners will be declared on the website and will be contacted on their phone numbers.

7. General terms and conditions

1. Failure to comply with any of these terms and conditions (including instructions) will disqualify Participant from continuing to take part in the Contest and such Participant's participation will be invalid. Britannia retains the sole discretion to refuse participants the right to participate if it is of the view that these terms and conditions are being violated.

2. Britannia shall not be liable to award/provide the prize(s) and/or declare the winners of the prizes of the Contest due to any cause beyond its reasonable control or foresight, including but not limited to: act of god, insurrection or civil disorder, religious strife, war or military operations, terrorist act, partial or total strikes, either internal or external, lock-out, epidemic, blockage of means of transport or of supplies, national or local emergency, earthquake, fire, storm, flood, water damage, governmental, regulatory or legal restrictions, acts or omissions of persons for whom Britannia is not responsible.

3. By entering this Contest, Participants agree to hold harmless Britannia, its agencies, the judges and its affiliates, against any and all liability, damages or causes of action (however named or described) with respect to or arising out of: (i) Participant's participation in the Contest; (ii) the receipt or use of the prizes awarded; and (iii) the administration of the Contest and the distribution of prizes awarded. Participants hereby release, waive and discharge any and all claims of damage, loss or causes of action (including negligence) including but not limited to loss or damage to person or property which the Participant and his/her representatives or assignees may have, suffer or which may hereinafter accrue to the Participant or as a result of the PARTICIPANT'S participation in the Contest or use of the prizes awarded.

4. Britannia reserves the right to disqualify any Participant who tampers with the entry process or submits an entry that is not in accordance with these terms and conditions or who has, in the opinion of Britannia, engaged in conduct in entering or participating in the Contest which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Contest and/or Britannia. Britannia reserves the right to disqualify a winner if it becomes aware that the winner and/or the winner's entry/conduct falls under the ambit of a type described in this paragraph. Further, Britannia shall have the right to initiate necessary civil/criminal proceedings against such individuals indulging in such actions.

5. The Participant warrants that he/she holds the relevant rights to any and all materials submitted by him/her as part of the Contest including but not limited to all details mentioned on the entry form (“materials”) and neither the materials nor its exploitation by Britannia or its affiliates will infringe any rights of any third party. The Participant shall indemnify, defend, and hold harmless Britannia, its affiliates, its agencies and the judges of the Contest from any and all liability, loss, costs, damage, judgment, or expense (including reasonable attorney’s fees) resulting from or arising in any way out of any such claims by any third parties and/or which are based upon, or are the result of any breach of the warranties in this paragraph.

6. All Participants acknowledge and agree that the decisions of Britannia with respect to all aspects of the Contest are final and no correspondence will be entered into in this regard.

7. Britannia shall not be responsible for late, lost, illegible, falsified, delayed, incomplete or destroyed entries and all such entries are void and may be disqualified at any time. Britannia does not assume any responsibility for incorrect or inaccurate capture of entry information, technical malfunctions, human or technical error, lost delayed or garbled data or transmissions, omissions, interruptions, deletion, defect or failures of any telephone or computer lines or networks, computer equipment, software or any combination thereof. Entry materials/ data that have been tampered with or altered are void.

8. Britannia is not liable for any problems, errors, or negligence that may arise or occur in connection with this Contest, including but not limited to, any damage to the Participant's computer or other technical device, or software, as a result of the Participant's participation in this Contest. Britannia shall not be liable in any way for any failure or breach by any party in connection with this contest, prize or prizes and accepts no responsibility for any loss suffered by a participant arising from this contest, prize or prizes.

9. By entering into this contest, the participant acknowledged that it shall abide by all the terms and conditions of the virtual party host (Zoom). Any data shared on the party host platform shall not be the responsibility of Britannia. The Participant shall only participate in the contest after thoroughly reading the complying terms and conditions of the party host. If the participant has any dispute with the party host, the participant shall settle the same with the party host and it shall not raise any claims, complaint, dispute or concerns with Britannia regarding the same.

10. Britannia and/or any agency appointed by it, will collect Participants' information in order to conduct the Contest and subsequently for verification of identity of the Participant. If the information requested is not provided, the Participant would not be eligible to participate in the Contest. By entering the Contest, unless otherwise advised, each Participant also agrees that Britannia, agency appointed by it to carry out the Contest or aspects thereof, and/or Britannia’s affiliates may use this information, or disclose it to other organizations that may use it, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the Participant. Participants' personal information may be disclosed to government authorities and winners' names may be published.

11. Prizes will be given subject to the winner satisfying the verification process of Britannia.

12. Any tax including but not limited to gift tax, income tax or any other state/central tax as applicable to be paid by the winner to claim their prize.

13. The information each Participant provides will additionally be used for the purposes of administering this Contest and the prizes. All rights are reserved.

14. If any provision of these terms and conditions is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions, which shall remain in full force and effect. Indian laws shall be exclusively applicable to any and all disputes arising out of or in connection with the Contest or these terms and conditions. The courts at Bengaluru shall have sole jurisdiction over any and all disputes arising out of or in connection with this Contest.
